WELCOME, we are Marmot Jaguar Corp. (“Marmot”, “Marmot Jaguar”, “us”, “our”, and “we”)! We take privacy very seriously and work hard to preserve your privacy and security while being as transparent as possible when explaining how we use the data and information you provide while using our App., Service, and Site (collectively “Service”). The following terms make up our “Privacy Policy” which is incorporated into and subject to our Terms of Use (“Terms”) located here www.mjmaryjane.com. Please read both documents carefully.

WHAT DOES THIS PRIVACY POLICY DO? This Privacy Policy along with the Terms describes how Marmot Jaguar handles, uses, processes, and discloses “User Data” (defined below) and “User Content” made available or provided by you while using our Service. By submitting any User Content through our App., Service, or Site, you expressly consent to the transfer of such data and information, some which could be personal in nature, to our servers in the U.S. for our collection, use, and disclosure in accordance with this Privacy Policy and Section 1.17 of the Terms (Compliance with Laws and Regulations).

WE DO NOT OWN THE DATA AND INFORMATION (“USER CONTENT”) YOU PROVIDE WHEN USING OUR SERVICE! However, we do maintain those rights (license) as granted to us in Section 1.3 of the Terms (Ownership & License).

WHAT (AND HOW) DATA AND INFORMATION DO WE COLLECT? By using our App., Service, and Site we collect, either automatically (e.g. IP Addresses) or by your actions (e.g. uploading) the following three types of data and information: (1) User Content; (2) User Data; and (3) Third-Party Data.

  • IMAGE DATA COLLECTION AND USE. Your privacy is important to us, and we are committed to providing transparency about how we handle your data. As part of our services, our application collects and uploads image data. This collection of image data is necessary to provide certain features and functionalities of our application. These could include (but are not limited to): image editing, sharing images, creating image albums, analyzing images for automatic tagging, etc. (Specify what you use the images for). By using our services and agreeing to this Privacy Policy, you give us consent to collect, store, and process your image data. We want to assure you that the collection, processing, and storage of this data is done with your privacy and security in mind. We employ industry-standard security measures to protect your data. The collected image data may be stored on our servers and could be used to improve our services. We do not share your image data with third parties, except as described in our Privacy Policy or with your explicit consent. Please be aware that by using our application, you consent to the collection and use of your image data as described in this Privacy Policy.   • USER CONTENT. In addition to how User Content is defined in Section 1.2 of the Terms (Types of Content), User Content includes the data and information you submit when using the App., Service, or Site (e.g., content in the user’s profile or postings). You are solely responsible for all User Content and must be mindful of your own privacy needs as you choose who to connect with and what to share and make public. We cannot control the privacy or security of information you choose to make public or share with others as such you assume all risks associated with use of your User Content, including any reliance on its accuracy, completeness or usefulness by others, or any disclosure of your User Content that makes you or any third party personally identifiable. You represent and warrant that all User Content you provide does not violate this Privacy Policy or our Terms. You may not state or imply that your User Content is in any way provided, sponsored or endorsed by Marmot. Because you alone are responsible for your User Content (and not Marmot), you may expose yourself to liability if, for example, your User Content violates a law, regulation or policy. Marmot is not obligated to backup User Content and User Content may be deleted as described below.
  • USER DATA.We collect data and information about you and how you use the App., Service and Site (“User Data”). When you create a user account we collect your: (i) user name; (ii) email address; (iii) password (as encrypted) and (iv) information about your application, operating system, browser and device information. User Data is automatically collected by our use of cookies on the website, beacons, and URL information. Cookies are small pieces of information a website sends to your computer\`s hard drive while you are viewing a website. We may use both session cookies (which expire once you close your web browser) and persistent cookies (which usually stay on your computer until you delete them) to provide you with a more personal and interactive experience when using our Site and Service. Web beacons are digital images that are used to log information on the Service or in our emails. We use Web beacons to manage cookies, count visits, and to learn what marketing works and what does not. We also use Web beacons to tell if you open or act on our emails.
  • THIRD PARTY DATA AND SOCIAL NETWORKS. If you create a user account by connecting or associating your account to, a social networking services account (“SNS”) (e.g. Twitter or Facebook), we collect the data and information provided to us by the SNS including your: name; email address; birthday; geographic location; interests; profile picture; gender; networks; user ID; list of friends; and any information you have made public on such social networking account. If you elect to share your information with these SNS, we will share information with them in accordance with your election. The SNS Terms of these SNS will apply to the information we disclose to them. We do not target our Service toward any particular group of users. We do not store any users’ information in retrievable form and only contact users via push notifications and popup message to advise them of software updates or other general administrative or technological notices.   • PERSONAL OR REGULATED DATA AND INFORMATION? We do not knowingly collect information which is regulated. For example, information characterized as personally identifiable information (“PII”) or information regulated under the Health Insurance Portability and Accountability Act of 1966 (“HIPAA”) is not knowingly collected by us unless you choose to provide this type of information. In the event you choose to provide this type of information you do so at your own risk, knowing that our Service is not compliant with such laws and regulations as HIPAA. We are not responsible or obligated to manage or protect such information as required by HIPAA or the applicable law or regulation.   • WHAT DO WE DO WITH THE DATA AND INFORMATION WE COLLECT? The data and information we collect is used for a number of things (depending on the type of data and information collected) including to recommend content or determine whether the information you have requested is available in your location: (i) the facilitation and creation of an active user account; (ii) to identify you as a user of our Service; (iii) to provide, personalize, and improve the Service; (iv) to communicate with you about your use of the Service; (iv) to develop new products and services; (v) to customize the advertising you view and recommend content; (vi) to fulfill your requests; (vii) to send newsletters, surveys, offers and promotional materials related to the Service and for other marketing purposes of Marmot; (viii) to protect, investigate, and prevent potentially fraudulent, unauthorized, or illegal activities; and (ix) to use your geographic location (opt-in).
  • YOU CAN SHARE YOUR USER CONTENT. A material part of our Service is to enable sharing of User Content. Section 1.4 of the Terms (Content Sharing) provides information about this functionality. Please consider carefully what you choose to Share or make public as you are entirely responsible for the User Content you Share. We do not monitor or control what others do with User Content. It’s your responsibility to let other users know how the User Content may be shared and adjust the setting related to accessing or sharing of User Content. The Service may allow you to comment on others’ Content, such comments are not anonymous, and may be viewed by other Users.
  • WHEN DO WE SHARE OR DISCLOSE THE DATA AND INFORMATION COLLECTED? In addition to the above information about “What we do with data and information collected” we will only share or disclose your data and information (including if necessary any personal information) under the following situations: (i) to protect our rights and the rights of other users; (ii) with others who perform services on our behalf (a third-party service); (iii) if we believe we are required to do so by law, or to comply with a court order, judicial or other government subpoena, or warrant; (iv) if we believe doing so is appropriate or necessary to prevent any liability, or any fraudulent, abusive, or unlawful uses; (v) to protect the rights, property, or personal safety of Marmot or others; (vi) in the event Marmot is or may be acquired by or merged with another company or involved in any other business deal (or negotiation of a business deal) involving sale or transfer of all or part of our business or assets, we may transfer or assign your information as part of or in connection with the transaction; (vii) in the event of insolvency, bankruptcy, or receivership, information may be transferred as a business asset; (viii) if aggregated and/or anonymized, with our partners, advertisers, or other third parties; or (ix) if you access or associate your Account with a Social Networking Service.   • HOW LONG DO WE HOLD THE DATA AND INFORMATION COLLECTED? Our servers store both User and Data Content. We retain User Data for as long as you use the Service and for an indefinite time thereafter. Text messages received are stored for 72 hours and then deleted. Deleted messages cannot be recovered. All messages are stored in encrypted form on our servers.
  • DISCLAIMER ON COLLECTION AND TRANSFER OF DATA AND INFORMATION. This Privacy Policy does not apply to and we are not responsible for other parties including third party analytics service providers and advertising partners who collect personally identifiable information about your online activities over time and across different Web sites when you use our Service. You are responsible for and we encourage you to review the privacy policies of these third parties to learn what information they collect from you. If you use our Service and reside outside the U.S., your information will be transferred to the U.S. and will be processed and stored there under U.S. privacy standards. By using our Service and providing information to us, you consent to such transfer to and processing in the U.S. You are responsible for complying with any laws or regulations in your country that govern use of applications and services like Marmot.   • WHAT ABOUT SECURITY? Marmot takes commercially reasonable steps to help protect the data and information against loss, misuse and unauthorized access, or disclosure. No company can fully prevent security risks, however. While we strive to protect your personal information, we cannot guarantee its absolute security. To help protect yourself and your information, choose a unique password (which we encrypt) for our Service and do not use a password on our Service that you would use on any other website or online service.
  • INFORMATION CHOICES. You always have the right to know what personal information Marmot has about you and to correct any inaccuracies. Please direct any such requests by email to info@mjmaryjane.com.
  • I JUST AGREED TO THE GENERAL TERMS OF USE AND END USER LICENSE AGREEMENT, WHY DO I HAVE TO AGREE TO THIS PRIVACY POLICY? Your agreement to BOTH this Privacy Policy, and our Terms is a material condition to your use of the App., Service and Site. What this means is that the terms of both this Privacy Policy and the Terms work together to define and control your use of our App., Service and Site, and are to be interpreted and integrated as a single set of terms and conditions. For example: (i) unless otherwise described, the definitions used in the Terms shall apply to this Privacy Policy; or (ii) if you have a dispute under this Privacy Policy, you must be aware that all of the terms and conditions, (examples: Warranty, Indemnification and the and Jurisdiction sections) in the Terms will apply and control even though they are not specifically stated in this Privacy Policy. Keep in mind there may exist similar concepts in both this Privacy Agreement and the Terms and if this is the case, then generally speaking, all privacy related terms as used in this Privacy Policy will control.
